Our Policy

PRIVACY POLICY

This Privacy Policy explains how Titan eCommerce PTY LTD (ACN 603 955 219, ABN 86 603 955 219, “Titan”, “we”, “us”, “our”) collects, uses, discloses and protects your personal information.

We are bound by the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and we take our obligations seriously. If you have any questions after reading this policy, please contact us using the details in Section 13.

1. Who We Are

  1. Titan eCommerce is an Australian-owned web hosting provider founded in Melbourne in 2014.
  2. Our registered office is at 402/517 Flinders Lane, Melbourne VIC 3000, Australia.
  3. We provide shared, reseller, VPS, cloud and dedicated hosting services together with related products including domain registration, SSL certificates, backups and migration assistance.

2. The Personal Information We Collect

  1. Identity and contact information. Full legal name, billing address, phone number and email address you provide when registering for an account or contacting us.
  2. Business information. Company name, ACN/ABN, role and any other organisational details you provide when registering on behalf of a business.
  3. Payment information. Credit card details and billing addresses processed through our PCI-DSS compliant payment processors. Titan does not store full card numbers on our servers; only tokenised references and the last four digits.
  4. Account and service information. Plan details, domain names registered, server configurations, usage statistics, and support history.
  5. Technical information. IP addresses, browser type, device identifiers, log files, and information about your interactions with our website and customer portal.
  6. Marketing preferences. Your preferences for receiving communications and the source by which you first contacted us.

3. How We Collect It

  1. Directly from you when you sign up, place an order, contact our support team, complete a form on our website, or speak with our sales team.
  2. Automatically when you visit our website or use our customer portal, through cookies and similar technologies (see Section 7).
  3. From third parties where you authorise us to collect information on your behalf — for example, domain registrars, payment processors, or migration source providers.
  4. From publicly available sources such as company registries where we need to verify business details.

4. How We Use Your Personal Information

  1. To provide the services you have purchased, including provisioning accounts, managing domains and delivering support.
  2. To process payments, issue invoices, send renewal reminders, and recover any amounts owed.
  3. To respond to your enquiries, complaints and support requests.
  4. To send service-related communications such as maintenance windows, security advisories, billing notifications and policy updates.
  5. To send marketing communications about our products and services, where you have opted in to receive them. You can unsubscribe at any time using the link in any marketing email.
  6. To improve our services, including analysing aggregated usage patterns, debugging issues, and developing new features.
  7. To detect, investigate and prevent fraud, abuse, security incidents and violations of our Terms of Service.
  8. To comply with our legal obligations, including responding to lawful requests from regulators or law enforcement.

5. Who We Share It With

  1. Service providers. Trusted third parties who help us deliver the services, including payment processors, domain registrars (such as auDA-accredited registrars for .au domains), SSL certificate authorities, email delivery providers, and Cloudflare for DDoS and CDN services. We provide them only with the information they need.
  2. Professional advisers. Our lawyers, accountants and auditors, bound by confidentiality obligations.
  3. Regulators and law enforcement. Where we are legally required to disclose information, including under valid Australian court orders or subpoenas.
  4. Successors in interest. In the event of a merger, sale of business or restructure, your information may be transferred to the acquiring entity under equivalent privacy commitments.
  5. We do not sell or rent your personal information to third parties for marketing purposes.

6. The Content You Host With Us

  1. The files, databases, email messages and other data you host on our infrastructure (“Your Content”) remain your property at all times. Titan does not access Your Content except as necessary to provide the services, investigate suspected abuse, or respond to lawful requests.
  2. Where your visitors or customers provide personal information through a website hosted on our platform, you are the data controller for that information and responsible for your own privacy obligations to those individuals.
  3. We process Your Content as your data processor under your instructions, and only for as long as you are an active customer (plus a short post-termination grace period as set out in our Terms of Service).

7. Cookies and Tracking Technologies

  1. Our website uses cookies to keep you signed in, remember your preferences, secure your session, and measure how the website is used.
  2. We use a small number of analytics cookies (for example to measure page views) and may use marketing cookies where you have consented through our cookie banner.
  3. You can disable cookies in your browser settings, but some parts of our website and customer portal will not function correctly without them.

8. Data Security

  1. We take reasonable steps to protect your personal information from unauthorised access, use, modification, loss or disclosure.
  2. Security measures include encryption in transit (TLS) for all customer portal and website traffic, encryption at rest for sensitive credentials, hardened production infrastructure, restricted staff access, multi-factor authentication for our internal systems, and regular security reviews.
  3. Despite our best efforts, no method of transmission over the Internet or storage system is 100% secure. If we become aware of a breach affecting your personal information, we will notify you and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.

9. Where Your Data Is Stored

  1. Customer account data and primary hosting infrastructure are located in Australia.
  2. Some of our third-party service providers (for example global CDN and email delivery providers) may process limited data outside Australia, including in the United States and the European Union. Where personal information is transferred overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the Australian Privacy Principles.

10. Data Retention

  1. We retain your account and billing information for as long as you are a customer, and for a further seven (7) years after account closure to meet Australian tax, accounting and record-keeping obligations.
  2. Hosted content (Your Content) is deleted within fifteen (15) days of account termination, except where we are required to retain it for legal reasons.
  3. Support correspondence is retained for up to three (3) years to help us resolve recurring issues and improve our service.
  4. Marketing data is retained until you withdraw consent or are inactive for two (2) consecutive years.

11. Your Rights

  1. Access. You have the right to ask for a copy of the personal information we hold about you.
  2. Correction. You can ask us to correct any personal information that is inaccurate, out of date or incomplete.
  3. Deletion. You can ask us to delete personal information we no longer need to retain, subject to any legal record-keeping obligations.
  4. Opt-out. You can opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting our support team.
  5. Complaints. If you believe we have mishandled your personal information, please contact us first using the details below. If we do not resolve your concern to your satisfaction, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

12. Changes to This Policy

  1. We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page reflects the most recent revision.
  2. Where a change materially affects how we handle your personal information, we will notify existing customers by email before the change takes effect.
